These Terms & Conditions explain the terms on which we supply products to you. Please read them carefully before placing an order.
Nothing in these Terms affects your statutory rights as a consumer.

1.3 In these Terms, references to “Motion Beds”, “we”, “us” or “our” mean BELMEDIA LTD trading as Motion Beds.
1.4 These Terms primarily apply to customers purchasing products for personal and domestic use.
2. How the Contract Is Formed
2.1 When you place an order with us, you are making an offer to purchase the products included in that order.
2.2 After you place your order, we may send you an acknowledgement confirming that we have received it. This does not necessarily mean that we have accepted your order.
2.3 A contract between you and us will be formed when we send you confirmation that your order has been accepted (“Order Confirmation”).
2.4 The Contract will relate only to the products identified in the Order Confirmation.
2.5 If we are unable to accept your order, we will tell you and will not charge you for the product. If payment has already been taken, we will refund the amount paid.
2.6 We will assign an order number to your order. Please quote this number whenever you contact us about your order.
2.7 Our website is intended for customers in the United Kingdom. We do not normally accept orders for delivery outside the areas we serve in the UK.
2.8 Some remote or offshore locations may require different delivery arrangements or an additional charge. Where an additional delivery charge applies, this will be agreed with you before we proceed with the order.
3. Our Products
3.1 We take reasonable care to ensure that product descriptions, specifications, dimensions, prices and images on our website are accurate.
3.2 Measurements are as accurate as reasonably possible but may be approximate.
3.3 Product images are for illustrative purposes. Although we make reasonable efforts to display colours accurately, the colour shown on your screen may vary depending on your device and display settings.
3.4 Where you select a fabric, finish or material from a sample, reasonable variations in colour, shade, texture and pattern may occur between batches and between a sample and the finished product.
3.5 We operate a policy of continuous product development and may make minor changes to specifications or construction where these do not materially affect the product's appearance, quality, safety or functionality.
3.6 Where a product is made to your chosen size, fabric, configuration or other specification, you are responsible for checking that the details shown in your order are correct before submitting it.
3.7 If you discover an error in your chosen specification after ordering, please contact us immediately. We will try to accommodate changes where reasonably possible, but changes cannot always be made once manufacturing has begun.
3.8 Our products are primarily intended for domestic and private use unless expressly stated otherwise.
4. Prices and Payment
4.1 The price payable for a product will be the price shown when you place your order, subject to any applicable VAT relief and except in the case of an obvious pricing error.
4.2 Unless otherwise stated, prices shown as VAT-inclusive include VAT at the prevailing rate.
4.3 Where a VAT-relief price is displayed, that price is only available where both the customer and the product qualify for VAT relief.
4.4 Delivery charges, additional services and any other charges payable by you will be disclosed before the relevant service is agreed.
4.5 We may change our prices at any time, but a price change will not affect an order that we have already accepted.
4.6 If we discover an obvious pricing error before accepting your order, we will contact you and give you the opportunity to continue at the correct price or cancel the order.
4.7 If we accept and process an order where a pricing error was obvious and could reasonably have been recognised as an error, we may contact you to correct the error and, where permitted by law, cancel the order and refund any amount paid.
4.8 Payment may be made using the payment methods made available to you at checkout or otherwise agreed with us.
4.9 You must provide complete and accurate payment, billing and contact information.
5. VAT Relief
5.1 Certain products supplied by Motion Beds may qualify for VAT relief where the relevant legal requirements are satisfied.
5.2 VAT relief is not available simply because a customer is older or because a product may be useful to them. The customer and the product must meet the applicable eligibility requirements.
5.3 Where you apply for VAT relief, we may ask you to complete an eligibility declaration and provide the information reasonably necessary for us to determine whether VAT relief can be applied.
5.4 You are responsible for ensuring that the information you provide in an eligibility declaration is complete and accurate.
5.5 We are responsible for applying the appropriate VAT treatment to our supply. Where the conditions for VAT relief are not satisfied, VAT will be charged at the applicable rate.

5.7 Information provided in connection with VAT relief will be handled in accordance with our Privacy Policy.
6. Delivery
6.1 Delivery information and estimated lead times are shown on our website and may vary by product.
6.2 Many Motion Beds products are manufactured or prepared to order. Any lead time shown is an estimate unless we expressly agree a specific delivery deadline with you.
6.3 Once your order is ready, we will contact you to arrange a suitable delivery date.
6.4 We normally deliver large Motion Beds products using our own delivery team. Where we use a specialist delivery provider, we remain responsible for delivery to you in accordance with our legal obligations.
6.5 Where installation is included, our team will normally:
-
bring the product into the agreed room;
-
assemble and position it where required;
-
test the product and its movement;
-
explain how the controls work; and
-
remove packaging associated with the new product.
6.6 Delivery and installation are subject to safe and reasonable access.
6.7 You are responsible for ensuring that:
-
access to the property is safe and clear;
-
doors, corridors, staircases and lifts are suitable for the product;
-
the room is reasonably accessible;
-
any obstacles that could prevent delivery have been removed; and
-
an authorised adult is available to accept delivery.
6.8 Our team will not be required to carry out a delivery or installation where they reasonably believe doing so would place anyone at risk or cause damage to your property or the product.
6.9 If we cannot complete delivery because you are unavailable, have provided incorrect information or have not provided reasonable access, we may arrange another delivery and may charge you reasonable additional costs that arise as a result. We will tell you about any charge before arranging redelivery.
6.10 If you know that your property has restricted access, unusual stairs, narrow doorways or any other circumstances that may affect delivery, please tell us before ordering.
6.11 Old bed removal may be available as an optional paid service. Availability and the applicable charge will be confirmed when you add or arrange that service.
6.12 We will take reasonable steps to deliver your order within the agreed or estimated period.
6.13 If delivery is delayed by an event outside our reasonable control, we will contact you as soon as reasonably possible and take steps to minimise the effect of the delay.
6.14 Nothing in this section limits any statutory rights you may have where goods are not delivered within an agreed or legally required period.
7. Risk and Ownership
7.1 The products remain at our risk until they are delivered into the physical possession of you, or a person identified by you to receive them.
7.2 Ownership of the products will pass to you when:
-
the products have been delivered; and
-
we have received payment in full,
whichever happens later.
8. Cancelling an Order Before Delivery
8.1 If you want to change or cancel an order before delivery, please contact us as soon as possible.
8.2 Whether we can accept a cancellation before delivery will depend on the product, whether it has been made to your specification and whether production has begun.
8.3 Goods that are made to your specifications or clearly personalised are generally excluded from the ordinary statutory right to cancel a distance contract simply because you have changed your mind.
8.4 This does not affect our separate 14-Day Home Trial, which voluntarily extends to qualifying Motion Beds products including products made to your chosen size or fabric as described below.
8.5 Nothing in this section affects your rights where products are faulty, misdescribed or otherwise do not conform to the Contract.
9. Our 14-Day Home Trial
9.1 In addition to your statutory rights, Motion Beds provides a voluntary 14-Day Home Trial on the beds, mattresses and chairs covered by our trial.
9.2 This is a voluntary promise from Motion Beds and is separate from your statutory cancellation and consumer rights.
9.3 The trial begins on the day the product is delivered.
9.4 Our voluntary trial also applies to covered beds made to your chosen size, fabric or specification, even where the ordinary statutory change-of-mind cancellation right would not apply because the product is bespoke.
9.5 The purpose of the trial is to allow you to properly experience the product at home. You may therefore use the product normally during the trial.
9.6 If the product is not right for you, you must notify us within the 14-day trial period by contacting us on 0800 870 8582 or through Customer Service.
9.7 Where a return is accepted under our voluntary home trial, we will arrange collection.
9.8 The following collection charges apply to returns made under the voluntary trial:
-
Bed: £185
-
Riser recliner chair: £120
-
Mattress: £55
9.9 Collection charges apply per item. If more than one item is returned, the applicable charge for each returned item will apply.
9.10 The collection charge will normally be deducted from your refund.
9.11 These home-trial collection charges do not apply where the product is being returned because it is faulty, damaged, misdescribed or otherwise does not conform to the Contract.
9.12 We expect products to have been used during the trial. However, you must take reasonable care of them.
9.13 Products returned under the voluntary trial should:
-
be kept clean;
-
be free from stains, tears, burns and pet damage;
-
not have been damaged through misuse, neglect or unreasonable treatment;
-
include the handset, legs, fittings and accessories supplied with them; and
-
be reasonably accessible to our collection team.
9.14 If a product is returned with damage beyond what could reasonably result from normal use during the trial, we may make a reasonable deduction from the voluntary-trial refund to reflect the reduction in value. We will explain any such deduction.
9.15 Once the returned product has been received back by us, we will issue the amount due under the home trial to your original payment method within 14 days.
9.16 Where VAT relief applied to your original purchase, the starting amount for your refund will be the amount you actually paid, subject to the applicable trial collection charge and any permitted deduction.
9.17 A faulty product is not treated as a home-trial return. Faulty products are dealt with under your statutory rights and any applicable product guarantee.
10. Your Statutory Right to Cancel Non-Bespoke Online Orders
10.1 Our voluntary 14-Day Home Trial does not replace your statutory cancellation rights.
10.2 If you purchase goods online, by telephone or through another distance-selling method, and the goods are not made to your specification or clearly personalised, you will normally have a statutory right to cancel the Contract without giving a reason.
10.3 You normally have 14 days from the day you, or a person nominated by you, receives the goods to tell us that you wish to cancel.
10.4 If an order is delivered in separate instalments, the cancellation period normally runs from the date you receive the final part of the order.
10.5 To exercise this right, you must clearly tell us that you wish to cancel. You may contact us by email, telephone or post. You may also use the Model Cancellation Form at the end of these Terms, although you are not required to use it.
10.6 You must then return the goods or make them available for agreed collection without undue delay and normally within 14 days of telling us you wish to cancel.
10.7 If you are legally responsible for the cost of returning goods, you must pay the direct cost of return or collection where we have informed you of that responsibility as required by law.
10.8 For large products that cannot normally be returned through ordinary post, please contact us so that collection arrangements and the applicable direct collection cost can be confirmed.
10.9 Where a valid statutory cancellation right is exercised, we will refund payments due to you, including the cost of our least expensive standard delivery option where applicable.
10.10 We may make a deduction for any reduction in value caused by handling the goods beyond what is reasonably necessary to establish their nature, characteristics and functioning.
10.11 We will make the statutory refund without undue delay and within the period required by law.
10.12 The statutory change-of-mind cancellation right does not normally apply to goods made to your specifications or clearly personalised.
10.13 This exclusion from the statutory cancellation right does not remove any rights you have where goods are faulty, misdescribed or do not conform to the Contract, and it does not remove any additional rights we expressly give you under our voluntary 14-Day Home Trial.
11. Faulty, Damaged or Misdescribed Products
11.1 We have a legal duty to supply products that conform to the Contract.
11.2 Under the Consumer Rights Act 2015, goods must, among other things:
-
be of satisfactory quality;
-
be fit for their intended purpose; and
-
match their description.
11.3 If a product is faulty, damaged, misdescribed or otherwise does not conform to the Contract, please contact us as soon as reasonably possible.
11.4 In most cases, consumers have a short-term right to reject faulty goods within 30 days, subject to the provisions and exceptions contained in the Consumer Rights Act 2015.
11.5 After the short-term right to reject has expired, you may have a right to a repair or replacement.
11.6 If repair or replacement is unavailable, impossible, unsuccessful or not provided within a reasonable time without significant inconvenience, you may have further statutory rights including an appropriate price reduction or final right to reject.
11.7 The remedy that applies will depend on the circumstances and your statutory rights.
11.8 Where goods are validly rejected because they are faulty, damaged, misdescribed or otherwise do not conform to the Contract, we will bear the reasonable cost of returning or collecting them as required by law.
11.9 You will not be charged our voluntary home-trial collection fee for a return that is being handled as a valid faulty-goods claim.
11.10 Nothing in our guarantee, home trial or other store policies limits these statutory rights.
12. Guarantees and Motion Care
12.1 Our product guarantees are provided in addition to your statutory consumer rights and do not replace or restrict those rights.
12.2 The guarantee period and cover applicable to a particular product or component will be the guarantee represented to you for that product at the time of purchase, including any applicable product-specific written guarantee information.
12.3 We will honour the product guarantee promised to you when your Contract was formed.
12.4 Unless otherwise stated in the applicable guarantee, cover begins on the date of delivery.
12.5 Standard product guarantees generally apply to manufacturing faults and do not cover circumstances such as:
-
fair wear and tear;
-
accidental damage;
-
misuse or neglect;
-
damage caused by failure to follow operating or care instructions;
-
unauthorised alterations or repairs;
-
damage caused by animals;
-
unreasonable exposure to water, heat or weather; or
-
commercial or rental use where a product is sold for private domestic use.
12.6 If you believe you have a claim under a guarantee, please contact Customer Service with your order details and a description of the issue. We may reasonably ask for photographs or other information to help us assess the fault.
12.7 Depending on the applicable guarantee and circumstances, we may arrange inspection, repair or replacement.
12.8 Optional Motion Care plans may provide additional cover or services beyond the standard product guarantee. Motion Care is optional and subject to the terms provided when you purchase the plan.
12.9 Optional accidental damage insurance or other insurance products are separate from our standard guarantee and are subject to the terms of the relevant insurer.

13. Refunds
13.1 Refunds will normally be made to the original payment method used for the purchase unless another method is required or agreed.
13.2 Refunds under our voluntary 14-Day Home Trial are subject to the collection charges and conditions stated in section 9.
13.3 Refunds following a valid statutory cancellation will be handled in accordance with section 10 and applicable law.
13.4 Refunds relating to faulty goods will be handled in accordance with section 11 and your statutory rights.
13.5 Where a refund is due, we will process it within the applicable legal or contractual timeframe.
13.6 We are not responsible for additional processing time taken by your bank, payment provider or card issuer after we have issued a refund.
14. Our Rights to End the Contract
14.1 We may end the Contract if:
-
you do not make a payment when it is due;
-
you do not provide information reasonably required to supply the product;
-
you repeatedly fail to make suitable arrangements for delivery;
-
we cannot safely deliver the product because of circumstances that were not disclosed to us;
-
supplying the product would be unlawful; or
-
another circumstance arises in which we are legally entitled to end the Contract.
14.2 Where we end the Contract, we will tell you.
14.3 If we end the Contract because of something you have done, we may deduct or recover reasonable costs actually incurred as a direct result, where permitted by law.
14.4 If we end the Contract for a reason that is not your responsibility, we will refund amounts paid for products that we have not supplied.
15. Our Liability to You
15.1 We are responsible for losses you suffer that are a foreseeable result of our breach of the Contract or our failure to use reasonable care and skill.
15.2 Loss is foreseeable if it is obvious that it will happen or if, at the time the Contract was made, both you and we knew that it might happen.
15.3 Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for:
-
death or personal injury caused by our negligence;
-
fraud or fraudulent misrepresentation;
-
breach of your statutory consumer rights; or
-
any other liability that cannot lawfully be excluded or limited.
15.4 We primarily supply products for domestic and private use.
15.5 If you use a product for commercial, business or resale purposes without our written agreement, we will not be responsible for business losses such as loss of profit, loss of business, loss of revenue, business interruption or loss of business opportunity, except where the law does not permit us to exclude such liability.
16. Your Personal Information
16.1 We will use personal information you provide to us in accordance with our Privacy Policy.
16.2 We may use personal information where necessary to:
-
process and fulfil your order;
-
arrange delivery and installation;
-
take payment and provide refunds;
-
provide customer support;
-
administer guarantees or care plans;
-
process VAT-relief applications;
-
comply with our legal obligations; and
-
send marketing where we have a lawful basis to do so.

17. Website and Intellectual Property
17.1 The content of the Motion Beds website, including our branding, text, photographs, graphics, videos, product descriptions and website design, belongs to us or is used by us with permission, except where otherwise stated.
17.2 You may use our website for lawful personal purposes.
17.3 You may not reproduce, distribute, commercially exploit, alter or republish our website content without our permission except where permitted by law.
17.4 You must not misuse the website, attempt to gain unauthorised access to it, knowingly introduce malicious software or use the website for unlawful purposes.
17.5 Third-party trade marks, names and content remain the property of their respective owners.
18. Events Outside Our Control
18.1 We are not responsible for delays or failures caused by events outside our reasonable control.
18.2 Examples may include severe weather, transport disruption, fire, flood, epidemic or pandemic, industrial action, failure of utilities or telecommunications, government action or other circumstances we could not reasonably prevent.
18.3 If such an event affects your order, we will contact you as soon as reasonably possible and take reasonable steps to minimise the delay.
18.4 If there is a significant risk of substantial delay, you may contact us to discuss your options, including any right you may have to end the Contract and receive a refund for products you have not received.
19. Complaints
19.1 We want to resolve complaints quickly and fairly.

19.3 Please provide your name, order number where applicable, contact details and a description of the issue so that we can investigate it.
19.4 We will make reasonable efforts to resolve your complaint as quickly as possible.
20. Other Important Terms
20.1 Transfer of our rights. We may transfer our rights and obligations under the Contract to another organisation. If this happens and the transfer could materially affect your rights, we will tell you.
20.2 Transfer of your rights. You may transfer your rights under the Contract where the law permits. We may require reasonable evidence of any transfer, particularly where a product guarantee is being transferred.
20.3 Nobody else has rights under the Contract. Unless otherwise expressly stated, the Contract is between you and us and no other person has a right to enforce its terms.
20.4 If we delay enforcing the Contract. If we do not immediately insist that you comply with an obligation under the Contract, or if we delay taking action following a breach, this does not mean that we have waived our rights.
20.5 If part of these Terms is invalid. Each paragraph operates separately. If a court or other competent authority finds any part unlawful or unenforceable, the remaining provisions will continue in effect.
20.6 Changes to these Terms. We may update these Terms from time to time. The Terms applying to your purchase will normally be those in force when your Contract was formed unless a change is required by law or you agree otherwise.
20.7 Nothing in these Terms excludes liability for fraud or fraudulent misrepresentation or removes rights that cannot legally be excluded.
21. Governing Law and Courts
21.1 These Terms and your Contract with us are governed by the laws of England and Wales.
21.2 If you live in England or Wales, you can bring legal proceedings in the courts of England and Wales.
21.3 If you live in Scotland, you may bring legal proceedings in Scotland or England and Wales.
21.4 If you live in Northern Ireland, you may bring legal proceedings in Northern Ireland or England and Wales.
